The president tested positive for Covid on Thursday amid increasing Omicron sub-variant cases. 

The Omicron variants render much milder symptoms than previous variants, as is the case for Mr. Biden. With effective antivirals like Paxlovid, which is being taken by the president, symptoms can be even milder. 

The White House Covid coordinator, Dr. Ashish K. Jha, reported that Mr. Biden had a runny nose, was tired and had a dry cough. She stated that his symptoms did not warrant a visit to Walter Reed National Military Medical Center where presidents are generally treated.

The president's illness is a reminder to Americans that Covid is around and is here to stay.

Biden ran on a promise to neutralize Covid and has branded himself as pro-science, earning one of his few polling victories on how the president is handling the Covid pandemic. His contraction of Covid could be used to motivate more Americans to get vaccinated, as only two-thirds are. 

As the November midterms roll around, framing Covid as an enduring issue is advantageous to Democrats, who hope to cash in on their campaign to be perceived as the "party of science." 

For now, though, polls suggest that Covid-19 is of low importance to voters. The two highest concerns are the economy and parental rights in education, two categories in which Republicans are leading, and in which Biden is performing dismally.

Biden's overall job approval rating just reached an all-time low, a worrying statistic for Democrats. The weight of a president's approval heavily impacts congressional races. Biden needs to shake up the politiverse ahead of the midterms if he hopes to pursue any meaningful policy in the second half of his term.

The country's longest-serving prime minister, 67, was assassinated while campaigning for the ruling Liberal Democratic Party in the city of Nara, near Kyoto.

The shooter shot Abe because of his association with the Unification Church, a new religious movement founded in Seoul, South Korea, by Sun Myung Moon (1920–2012), a Korean messiah claimant. The church is known for its conservative-leaning political activism.

The death of this former prime minister, who served from 2007-2008, and then again from 2012-2020, shocked the Japanese nation where strict gun laws make shootings extremely rare.

The Chinese Civil War ended with the retreat of the Republic of China (ROC) to Taiwan, and the victors, the Chinese Communist Party (CCP), established the People's Republic of China (PRC) in mainland China, while the ROC ruled over Taiwan and several outlying islands.

During this time, both governments claimed to be the legitimate government of China. 

Initially, international recognition of the two was split, but most countries, including The United States, began to recognize the PRC over the ROC in the 70s. The language in the United States' One China policy first arose in its joint 1972 Communiqué with the PRC. 

China, which considers the democratically governed island to be its own territory, is increasing its pressure on Taiwan. The issue is a constant source of friction in relations between Beijing and Washington. 

Speaker Nancy Pelosi's trip would make her the most senior U.S. official to visit the island in 25 years. This diplomatic interaction with Taiwan could grant it legitimacy as a foreign government, potentially fueling the island's independence movement.

A Chinese warning to the United States changes the Pentagon's calculus on whether a diplomatic mission is worth escalating tensions with a superpower like China, that has already increased its military activity in the area.

- During a meeting in Saudi Arabia, Biden fist bumped Saudi Crown Prince Mohammed bin Salman (MBS), which was widely condemned.
- The CIA has reported that the Saudi Prince is responsible for ordering the shocking death of a Washington Post columnist in 2018.

Senator Richard Blumenthal challenged Altman on some of the negative consequences of AI, including deepfakes, voice impersonations, and potential job losses.

“Congress has a choice now. We had the same choice when we faced social media we failed to seize that moment. The result is predators on the internet, toxic content, exploiting children, creating dangers for them.”

Senator Josh Hawley tried to draw a comparison to other technologies.

“Is it going to be like the printing press, that diffused knowledge and power and learning widely across the landscape,” he asked, “or is it going to be more like the atom bomb, a huge technological breakthrough but the consequences severe, terrible, continue to haunt us to this day.”

Altman responded with reassurance that OpenAI had conducted extensive evaluations, external red-teaming, and dangerous capability testing. 

He also encouraged government regulation.

“We think that regulatory intervention by governments will be critical to mitigate the risks of increasingly powerful models.”

He offered a few approaches the Senate might consider, like a combination of licensing and testing requirements for the development, and release of AI models above a threshold of capabilities.

Christina Montgomery, Vice President and Chief Privacy & Trust Officer for IBM, was also testifying at the hearing. She encouraged Congress to adopt a precision regulation approach, establishing rules based on specific use cases, not regulating the technology itself. 

She outlined four guidelines for this approach:

1. Different rules for different risks. The strongest regulation applied to use cases with the greatest risks.
2. Clearly defining risks.
3. AI shouldn't be hidden. Consumers should know when they're interacting with an AI system.
4. For higher-risk use cases, companies should be required to conduct impact assessments that show how their systems perform against tests for bias.

Altman echoed point number three, saying that it should be obvious to users when they are interacting with AI. 

When pressed again about jobs disappearing, Altman offered an optimistic glimpse into the future, saying that he believes there will be far better jobs on the other side of AI development, and that jobs currently in existence will get better.

He also emphasized that GPT4 cannot take over a job at the moment, but can help people do their job.

“GPT4 is good at doing tasks, not jobs,” he said.

Senator Hawley followed up, asking Altman about the potential for one of these models to be used in a disinformation campaign to affect an election. He responded in the affirmative, saying one of his biggest concerns is the future ability of AI to “manipulate and persuade.”

“Given that we're going to face an election next year and these models are getting better, I think this is a significant area of concern... I do think some regulation would be quite wise on this topic.”

Altman took an apparent dig at Google, and other ad-based revenue companies:

“We don't have an ad-based business model so we're not trying to build up these profiles of our users. We're not trying to get them to use it more, actually, we'd love it if they use it less because we don't have enough GPUs. But I think other companies are already, and certainly will in the future, use AI models to create very good ad predictions of what a user will like.”

There was widespread agreement that there needed to be a separate agency to regulate AI, even from conservatives. Senator Lindsey Graham asked the panel:

“Do you agree with me that the simplest way and the most effective way is to have an agency that is more Nimble and smarter than Congress?”

Christina Montgomery, IBM’s representative, believed that AI should be regulated using the existing systems in place already, not with an entirely new agency.

Gary Marcus, a professor and cognitive scientist also testifying, agreed that there should be a separate agency and even global AI regulation laws.

In a surprising twist, Altman confirmed he has no equity in OpenAI, which owes nearly the entirety of its $29 billion net worth to ChatGPT.

Senator John Neeley Kennedy bantered with him on his financial situation. “You make a lot of money, do you?”

“Enough for health insurance. I own no equity in OpenAI,” he responded.

“Really?” Kennedy asked. “That’s interesting. You need a lawyer”.

“I’m doing this because I love it,” he responded.

These differing viewpoints pose a challenge to finding common ground and formulating bipartisan AI policies.

Like with social media, there is a knowledge gap among lawmakers regarding the complexities of AI technology. This was highlighted by their reference to Section 230, a provision that protects online platforms from legal liability for user-generated content. Altman tried to emphasize the distinction between social media and the subject of the hearing.

“I think it's tempting to use the frame of social media. But this is not social media. This is different and so the response that we need is different.”

Section 230 is 27 years old, which is ancient for internet technology. Critics argue that this broad immunity has allowed platforms to evade accountability for harmful content, while supporters maintain that it promotes free expression and innovation. Congress has been unable to agree on an effective update to the provision, suggesting AI regulation could be years away.

ChatGPT is only a specific implementation of AI technology. To effectively regulate AI, policymakers must acquire a deeper understanding of its intricacies and potential applications, beyond the scope of text-prompt tools like ChatGPT.

## Who is John Durham? What Was His Role?

John Durham, a seasoned prosecutor, was thrust into the national spotlight in 2019 when he was tasked with an unprecedented investigation by the Trump administration.

Trump’s Attorney General, William Barr, appointed Durham as special counsel, which is a way to conduct an investigation independently, without the risk of a conflict of interest with the usual prosecuting authority.

His job was to examine the FBI's handling of the 2016 probes into potential coordination between Donald Trump's campaign and Russian interference in the U.S. election.

The nature of this investigation into the investigators was inherently controversial, mired in a complex web of politics and competing narratives.

Durham's mandate was wide-ranging, encompassing the investigation into Trump's possible links with Russia, with a focus on the FBI’s probe — known as Crossfire Hurricane — and the investigation led by special counsel Robert Mueller. 

Mueller's 2019 report, concluded that Russia had indeed interfered in the 2016 presidential election but did not find sufficient evidence to charge any Trump campaign members for participating in a criminal conspiracy.

In the report, Durham comments on the extent of the investigation.

"The Office's investigation was broad and extensive. It included investigative work both domestically and overseas. It entailed obtaining large document productions from businesses, firms, government agencies, universities, political campaigns, internet service providers, telephone companies, and individuals. The Office interviewed hundreds of individuals, many on multiple occasions."

## What Questions Was he trying to Answer?

Durham outlines the purpose of the investigation in detail, and laid out five questions:

- Was there adequate predication for the FBI to open the Crossfire Hurricane investigation from its inception on July 31, 2016 as a full counterintelligence and Foreign Agents Registration Act ("FARA") investigation given the requirements of The Attorney General's Guidelines for FBI Domestic Operations and FBI policies relating to the use of the least intrusive investigative tools necessary?
- Was the opening of Crossfire Hurricane as a full investigation on July 31, 2016 consistent with how the FBI handled other intelligence it had received prior to July 31, 2016 concerning attempts by foreign interests to influence the Clinton and other campaigns? 
- Similarly, did the FBI properly consider other highly significant intelligence it received at virtually the same time as that used to predicate Crossfire Hurricane, but which related not to the Trump campaign, but rather to a purported Clinton campaign plan "to vilify Donald Trump by stirring up a scandal claiming interference by Russian security services," which might have shed light on some of the Russia information the FBI was receiving from third parties, including the Steele Dossier, the Alfa Bank allegations and confidential human source ("CHS") reporting? If not, were any provable federal crimes committed in failing to do so? 
- Was there evidence that the actions of any FBI personnel or third parties relating to the Crossfire Hurricane investigation violated any federal criminal statutes, including the prohibition against making false statements to federal officials? If so, was that evidence sufficient to prove guilt beyond a reasonable doubt? 
- Was there evidence that the actions of the FBI or Department personnel in providing false or incomplete information to the Foreign Intelligence Surveillance Court ("FISC") violated any federal criminal statutes? If so, was there evidence sufficient to prove guilt beyond a reasonable doubt?

“Our findings and conclusions regarding these and related questions are sobering,” Durham writes.

## Durham’s Critique of FBI's Reliance on Raw Intelligence

One of the key findings in Durham's report, which can be read in full [here](https://www.justice.gov/storage/durhamreport.pdf), was his criticism of the FBI's reliance on raw, unanalyzed intelligence in their investigation. 

The report suggested that the FBI moved too hastily, launching their investigation into Trump’s 2016 campaign based on uncorroborated evidence. In contrast, the FBI had briefed Hillary Clinton’s aides during her 2016 presidential campaign in advance when they gathered evidence of a foreign actor trying to garner influence with her. Clinton and Trump have been treated "markedly different," according to the report.

Durham's report details how the FBI launched the investigation with no evidence of contact between Trump campaign members and Russian intelligence officers. 

It specifically names Russia experts within the FBI who were not consulted before the investigation began. Had they been, Durham asserts, the investigation would have never started.

Durham recommended that a new position be created at the FBI to help vet and ensure the integrity of politically sensitive investigations. This, he argued, could prevent similar missteps in the future

This criticism and the serious accusations against the FBI underscored a lack of due diligence and an overreliance on unconfirmed evidence. 

The Justice Department's inspector general noted significant issues in the Russia investigation, especially concerning warrant applications for surveillance on Carter Page, a former Trump campaign advisor, which were riddled with errors and omissions.

This, in part, led to the four-year probe’s single guilty plea. Kevin Clinesmith, a former FBI lawyer, was sentenced to one-year probation after admitting to altering a government email used to justify the secret surveillance of Page.

Two other individuals, private researcher Igor Danchenko and cybersecurity lawyer Michael Sussman, were accused of lying to the FBI, but both were acquitted in court.

Durham adds this opinion on the matter of the acquittals.

“...the likelihood of an acquittal due to unpopularity of some aspect of the prosecution or because of the overwhelming popularity of the defendant or his/her cause is not a factor prohibiting prosecution.”

The report found no evidence of political bias among investigators.

## Reflection

The report raises significant questions about the practices of the FBI and other government agencies in their handling of politically sensitive investigations. Yet, the limited legal consequences resulting from the report suggest allegations of widespread FBI corruption might not be as substantiated as previously portrayed.

## A Familiar Critique

A number of the criticisms made in the Durham Report are not entirely new. A similar [2019 Justice Department report](https://www.justice.gov/storage/IGreport.pdf) by Inspector General Michael Horowitz had already identified what he called "serious performance failures" among FBI agents in the investigation. Following that report, FBI Director Christopher A. Wray implemented changes in the agency to address the identified issues.

However, Durham's report delves deeper and paints a more critical picture of the FBI's handling of the investigation than the previous report by Horowitz. While the Inspector General found no "documentary or testimonial evidence of intentional misconduct" by the FBI and validated their "authorized purpose" in initiating the investigation, Durham argues that the FBI's probe into Kremlin ties had been based on "raw, unanalyzed, and uncorroborated intelligence."

## “The Crime of the Century”

Donald Trump had high expectations for the Durham probe, predicting it would reveal the "crime of the century."

The governor's campaign chose to use Twitter spaces to host the event, taking a calculated risk. It was the first virtual presidential announcement to date, and reflects Elon Musk's vision for Twitter to be the "de-facto public town square."

As DeSantis prepared to make his grand entrance on Twitter's Spaces feature, technical difficulties plagued the platform, causing crashes, feedback glitches, and audio failures. The much-anticipated conversation with tech mogul Elon Musk, Twitter's owner, was delayed by a frustrating 25 minutes, leaving eager listeners hanging in suspense.

## An Unorthodox Choice

What made DeSantis' announcement remarkable was his decision to rely on an audio-only Twitter tool, Twitter Spaces, for such a significant occasion. This unorthodox choice attracted attention and scrutiny from critics who questioned the wisdom of relying on a platform still in its early stages. 

While the event was supposed to start at 6 pm CST, the interruption posed by the server crashes postponed the announcement by about 25 minutes.

Officially filing the necessary paperwork earlier in the day, he made it clear that he was entering the race for the Republican presidential nomination. 

In a pre-recorded video released by his campaign, DeSantis expressed his vision for an American comeback, emphasizing key issues such as crime and economic anxiety. The video was posted on his Twitter account before his official announcement.

When he finally had the opportunity to speak without interruption, DeSantis reiterated these points and criticized President Joe Biden's leadership style, accusing him of lacking vigor and being influenced by the "woke mob."
